This page (together with the documents mentioned in it) is the General Terms and Conditions ("Terms and Conditions") which relate to the domain http://dualpolska.com ("Site") and all subdomains on this Site. This Site is managed by DUAL Polska. Please read carefully the General Conditions
If you use this Site, we believe that you have accepted these General Terms and Conditions. If you do not accept these Terms & Conditions for the use of this Site, please refrain from accessing and using this Site.
Please note that the Site is intended solely for use by residents of Republic of Poland within the meaning of the Act of 27.07.2002 r. - Foreign Exchange Law (dated 15 June 2012., Journal of Laws of 2012. Pos. 826) ie. to persons who are resident on the territory of Poland. It is not applicable to residents or investors in other countries, as the law in other countries may restrict the distribution of information and products on the Site. For the avoidance of doubt, none of the information on the Site constitutes an offer to contract, as defined in Art. 66 § 1 of the Civil Code.
We may update our General Conditions at any time by amending this Site. We expect that from time to time you review this Site to note any changes we make, as they are binding for you.

"DUAL", "we," our "means DUAL Polska Sp. with o.o., based in Toruń, ul. Browarna 10, KRS number 0000251474, registered by the District Court in Toruń, VII Commercial Division of the National Court Register.
"Group" means any member of the group DUAL International Limited (registered in England and Wales under registration number 03540129), which includes DUAL Polska Sp. z o.o.
"Material" means the content of this Site, including, but not limited to, text, graphics, logos, links, codes and data.
Accessing the Site
DUAL will endeavor to ensure access to the Site 24 hours a day, but will not be liable if, for any reason, the Site is unavailable for any period of time. DUAL will have the right to suspend access to or to withdraw or restrict access to certain parts of the Site temporarily or permanently, without any prior notice.
DUAL will not be held liable for any damages or losses arising in contract, as a result of tort and other situations, if the Site is not available or suspended for any reason.
You are solely responsible for taking all actions necessary to access the Site. You are also responsible for ensuring that all people who access the Site using your Internet connection are aware of the contained General Terms and Conditions, and that they will adhere to these Terms and Conditions.
What is permitted on the Site

If you printed, copied or downloaded any part of the Site in violation of these Terms, your right to use the Site shall immediately expire and you must, at our choice, return or destroy all copies of materials that were made.

All intellectual property rights in the Site and in any material published on it (including, but not limited to, text, video, photographs and other images and sounds, trademarks and logos) are owned by DUAL, DUAL Polska or other members of the DUAL International group or their respective licensors. These rights are protected by intellectual property rights, and the provisions of the copyright agreements around the world. All such rights are reserved.
The information contained on this Site are presented solely for information purposes and DUAL will use all possible reasonable care and skill to ensure the validity of data at the time of their publication on the Site. However, due to the nature of the Internet, there may be circumstances in which the information errors occur. Therefore, DUAL does not give any warranty or guarantee as to the accuracy of the information contained in the Site and cannot accept responsibility for any errors or omissions in such information.
Reliance on the information posted
Commentary and other Materials on the Site are not intended as advice on which to rely when making decisions. Therefore, we will not accept any liability arising from any reliance placed on such Materials by any user of the Site or any third party who may be informed of its contents.

Limitation of Liability

(i) All conditions, warranties and other terms that would otherwise be imposed by the applicable provisions of Polish law.

Including, without limitation, any liability for:

- loss of anticipated savings

- loss of goodwill
- lost time of management or employees and
- any other loss or damage of any kind, however arising creation and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible assets or any other claims for direct financial loss that are not excluded by any of the categories listed above.
This does not affect our liability for death or personal injury resulting from our negligence nor our liability for fraudulent misrepresentation or misrepresentation as to the fundamental matter, nor any liability which cannot be excluded or limited under applicable law.

You should carefully read and agree to the terms and conditions of all such third-party sites before using them.
Viruses, hacking and other offenses
You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or any material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to the Website, the server on which the Website is stored, and any server, computer or database connected to the Website. You must not attack the Site via a denial-of-service attack or a distributed denial-of-service attack.
By breaking these provisions you would commit a criminal offence in accordance with the Law of 6 June 1997. - Penal Code (Dz. U. of 1997 No. 88 pos. 553 as amended.) We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will expire immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically hazardous materials that may infect your computer equipment, computer programs, data or other proprietary materials arising from your use of the Site or download of any material posted on the Site, or on any website linked to it.
Suspension and termination of the Site
DUAL may suspend or terminate the Site at any time. Access to or use of the Site or other sites associated with them, may not be uninterrupted or error-free.
Personal data and data protection
Within the contact form, you shall make a declaration in which you express your consent to the processing of information which you submitted to the Site by the Administrator of personal data.
The transfer of personal data by you is voluntary. You have the right at any time to obtain information about the content and the extent of processing of your personal data and to correct your date, by contacting the administrator of the Site.
DUAL will take all reasonable steps to ensure that all information provided by you by e-mail or through the Site is protected, but you must remember, that due to the nature of the Internet, e-mail security cannot be guaranteed. There is no guarantee that any e-mails sent by you to us will be received by us.
It is prohibited to supply by the User of false, incomplete, inaccurate, misleading, and illegal content. Administrator is not responsible for the consequences of providing false, incomplete, inaccurate and misleading data, as well as for the consequences of improper filling of the forms. You are solely responsible for providing illegal information.
DUAL may change these General Terms and Conditions from time to time and will be making efforts to inform you of such material changes by posting a message on the Site. You should check these Terms each time you visit the Site. These Terms constitute the entire agreement between the parties and supersede all prior agreements, understandings and representations relating to the subject matter. If any provision of these Terms and Conditions shall be deemed unenforceable, this shall not affect the validity of any other provision. DUAL may delay enforcing its rights under these Terms without losing them. DUAL is not responsible for any breach of these Terms and Conditions that arise in result of any circumstances which DUAL cannot reasonably be expected to control. You agree that DUAL may sub-contract the performance of any of its obligations or may assign these Terms and Conditions or any of its rights and obligations without giving you prior notice.
Governing Law and Jurisdiction
These General Conditions are subject to Polish law, and you hereby consent to the exclusive jurisdiction of the Polish courts in connection with these Terms & Regulations and in any dispute relating to them.
Polish courts shall have exclusive jurisdiction over any claim arising out of, or related to, the access to the Site. The competent court to settle disputes that may arise in connection with the use of this website by the user or the observance by him of these Conditions is a common court relevant to the location of DUAL Polska registered office..
